These Terms of Service ("Terms") govern your use of the website realdealempyre.com and any services purchased through it (the "Services"), offered by Real Deal Empyre LLC ("Real Deal Empyre," "we," "us," or "our"). By requesting an audit, purchasing the Fix-It Blueprint, subscribing to the Core Offer, or purchasing a website build, you agree to these Terms.
1. Services We Offer
- Free Audit — a no-cost review of your business's online presence (SEO, Google Business Profile, site speed, mobile usability, AI-search visibility, and related factors). No purchase is required and no obligation is created by requesting one.
- Fix-It Blueprint — a one-time, $5 personalized report built from your audit's findings, showing specific fixes and their priority. Delivered digitally.
- Core Offer — a $149/month subscription covering a real website, hosting, and ongoing Local SEO / Google Business Profile management, billed monthly and cancellable at any time (see Section 4).
- Website Build — a one-time $1,200 fee for a from-scratch website build, split 50% at the start of work and 50% upon your approval of the finished site, before it goes live. This fee is waived if we're taking over and improving an existing, usable site instead of building one from scratch.
2. Payment
All payments are processed securely through Stripe. We do not store your full payment card details on our own systems. Prices are in U.S. dollars. The Core Offer renews automatically each month until cancelled; if a renewal payment fails, we'll reach out before treating the subscription as cancelled for non-payment.
3. Refunds
- Fix-It Blueprint ($5) — non-refundable once delivered, since it's a personalized digital report built specifically for your business.
- Website Build deposit — fully refundable if you cancel before we've started real design/build work on your site. Once work has genuinely begun, the deposit becomes non-refundable, but we'll always tell you plainly where things stand before treating any milestone as "started."
- Website Build final payment — only collected after you've reviewed and approved the finished site, so it is non-refundable once paid.
- Core Offer subscription — no refunds for partial months. Cancelling stops future billing; it doesn't refund the current billing period.
4. Cancelling the Core Offer
You can cancel your Core Offer subscription at any time by contacting us. Cancellation takes effect at the end of your current billing period — you keep access through the period you've already paid for. There's no cancellation fee and no minimum term.
5. What We Need From You
Building or improving your site depends on you providing accurate business information and, where applicable, your own content (copy, photos, logo, brand assets) in a reasonably timely manner. Delays in providing what we ask for will delay the corresponding timeline — we'll always tell you what's blocking progress rather than letting a project silently stall.
6. Ownership
Once your Website Build is paid in full, you own the final website design and content we built for you. We retain ownership of our own general tools, code libraries, and methods used to build it (the reusable "how," not your specific site). If you supply your own domain, you keep full ownership and control of it. If we register a domain on your behalf, we do so only with your explicit approval of the exact domain name and cost, and ownership terms for that specific case will be confirmed with you directly before registration.
7. Limitation of Liability
We work carefully and stand behind what we build, but we can't guarantee specific search rankings, traffic, or revenue outcomes — those depend on many factors outside our control (competitors, algorithm changes, your own business factors). To the extent allowed by law, our total liability for any claim related to the Services is limited to the amount you actually paid us in the twelve months before the claim arose. We aren't liable for indirect, incidental, or consequential damages.
8. Termination
We may suspend or end Services if payment fails and isn't resolved after we've reached out, or if these Terms are violated. You may stop using the free Services (audit, Blueprint) at any time; paid subscriptions are governed by Section 4 above.
9. Changes to These Terms
We may update these Terms as the business grows. We'll post the current version here with an updated date. Continuing to use the Services after a change means you accept the update.
10. Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.
